1. PRIVACY POLICY

1.1 Introduction

ProdTracker.co, a service of Blue Tomato Media ("we," "us," "our," or "Service"), is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use our website and related services (the "Service").

1.2 Information We Collect

We collect information you provide directly and information collected automatically:

  • Account Information: Name, email address, company name, phone number, and other details you provide during registration
  • Payment Information: Billing address and company details. Payment data is processed by Stripe and is never stored on our servers
  • Content & Data: Tasks, projects, custom fields, team information, and all data you create within the Service
  • Communication: Messages, support requests, and feedback you submit to us
  • Usage Data: IP address, browser type, device information, pages visited, time spent, referring URL, and similar analytics
  • Cookies & Tracking: We use cookies for session management, authentication, and analytics. Third-party services like Google Analytics may also place tracking cookies

1.3 How We Use Your Information

We use collected information to:

  • Provide, maintain, and improve the Service
  • Process payments and manage your subscription
  • Send transactional emails (confirmations, receipts, password resets)
  • Send service updates and announcements
  • Respond to support requests and inquiries
  • Analyze usage patterns to improve the Service
  • Detect and prevent fraud, abuse, and security incidents

  • Organisational data isolation: each organisation's operational data is stored and processed in a logically isolated environment at the storage layer. A misconfiguration or application fault affecting one organisation cannot expose another organisation's data.

While we implement strong security practices in accordance with Article 32 of the GDPR, no system is 100% secure. You are responsible for maintaining confidentiality of your credentials.

1.6 Data Retention & Deletion

We retain your information for as long as your account is active or as needed to provide the Service. Upon account or organisation deletion, we perform a complete and verifiable removal of that organisation's data. Because each organisation's data is held in an isolated environment, deletion is comprehensive rather than incremental — it does not rely on identifying and removing individual records across shared tables. Personal information held for authentication purposes (name, email) is deleted within 60 days of account closure, except where retention is required by law.

1.7 Your Privacy Rights

You have the right to:

  • Access: Request a copy of your personal information
  • Correction: Update or correct inaccurate information
  • Deletion (Right to Erasure): Request deletion of your account and all associated organisational data. Our architecture enables complete and auditable erasure of your organisation's data upon request.
  • Restriction: Request that we restrict processing of your personal data in certain circumstances
  • Opt-Out: Unsubscribe from marketing emails (transactional service emails cannot be opted out)
  • Data Portability: Request your data in a portable format. Because your organisation's data is held in a self-contained, isolated environment, exports are complete and coherent rather than partial extracts from shared systems.

1.8 Governing Law & International Users

ProdTracker.co is a service of Blue Tomato Media, an Australian company. This Service is governed by the laws of Australia, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Nothing in these Terms limits any right you may have under Australian law.

Your information may be transferred to, stored in, and processed in countries other than your country of residence. By using the Service, you consent to the transfer of your information to countries that may have different data protection regulations.

Voluntary adoption of enhanced privacy protections

Although we are not legally required to comply with the European Union's General Data Protection Regulation (GDPR), we voluntarily adopt a number of its principles as a matter of best practice. These voluntary commitments include:

  • Data Protection by Design (cf. GDPR Art. 25): Our system architecture enforces data separation between organisations at the storage layer. Isolation is built into the design of the Service from the ground up.
  • Security of Processing (cf. GDPR Art. 32): We implement technical measures including encrypted transmission, access controls, parameterised queries, and organisational-level data isolation.
  • Right to Erasure (cf. GDPR Art. 17): Deletion of an organisation account results in complete removal of that organisation's data. We treat this as a verifiable, comprehensive operation.
  • Data Portability (cf. GDPR Art. 20): Your organisation's data can be exported as a complete, self-contained dataset on request.

These commitments are voluntary and do not constitute legal obligations under Australian law. They reflect our view that strong data practices are good business, not just legal compliance. For any privacy-related requests, contact us. We will respond within 60 days.

1.9 Third-Party Services

The Service integrates with third-party services including Stripe for payments. These services have their own privacy policies. We are not responsible for their practices.

1.10 Children's Privacy

The Service is not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child has provided information, contact us immediately.

2. TERMS OF SERVICE

2.1 Acceptance of Terms

By accessing and using ProdTracker.co, a service of Blue Tomato Media, you accept and agree to be bound by these Terms. If you do not agree to abide by the above, please do not use this Service.

2.2 Use License

Permission is granted to temporarily download one copy of the materials (information or software) on ProdTracker.co for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to decompile, reverse engineer, or disassemble the Service
  • Remove any copyright or other proprietary notations
  • Transfer the materials to another person or "mirror" the materials on any other server
  • Violate any applicable laws or regulations

2.3 Disclaimer

The materials on ProdTracker.co are provided on an "as is" basis. We make no warranties, expressed or implied, regarding:

We do not guarantee that the Service will always be available or that operations will be uninterrupted, though we make good-faith efforts to maintain service availability.

2.4 Limitations of Liability

In no event shall ProdTracker.co, its founders, employees, agents, or service providers be liable for any damages (including, without limitation, damages for loss of data, loss of profits, loss of revenue, business interruption, loss of business opportunity, or consequential, incidental, indirect, special, or punitive damages) arising out of or in connection with:

  • Your use of or inability to use the Service or any materials on ProdTracker.co
  • Service downtime, unavailability, interruptions, or technical failures
  • Unauthorized access to or alteration of your content or data
  • Loss, corruption, or deletion of data (whether from backup failure, user error, or other cause)
  • Actions or inactions of third parties, including other users
  • External factors beyond our reasonable control (natural disasters, power outages, internet disruptions, etc.)
  • Your reliance on information, advice, or content provided through the Service
  • Any breach of security or data compromise, even if we were notified of the possibility

Even if ProdTracker.co has been advised of the possibility of such damages, our total cumulative liability to you for all claims arising from your use of the Service shall not exceed the total amount you paid to ProdTracker.co in the 12 months immediately preceding the claim. If you paid nothing, our liability is limited to $100.

No Compensation for Service Downtime: You acknowledge that internet-based services are not always available and may experience downtime for maintenance, updates, or unforeseen technical issues. Except where required by mandatory law, we provide no compensation, refunds, or credits for any service downtime, unavailability, or interruptions, regardless of the cause or duration. We make good-faith efforts to maintain service availability and reliability, but do not guarantee uninterrupted access. Your sole remedy for extended service unavailability may be account cancellation, as stated in our Refund Policy.

Assumption of Risk: You understand that using the Service involves risks, including but not limited to data loss, security breaches, service interruptions, and errors. By using the Service, you assume all risks associated with your use. You acknowledge that you are using the Service at your own risk and that we are not responsible for:

  • Any loss or corruption of your data for any reason
  • Your failure to maintain independent backups of critical data
  • Any decisions you make or actions you take based on information from the Service
  • Your business results or outcomes from using the Service
  • The accuracy, completeness, or usefulness of information provided by other users

2.5 Accuracy of Materials

The materials appearing on ProdTracker.co could include technical, typographical, or photographic errors. We do not warrant that materials on the Service are accurate, complete, or current. We reserve the right to make changes to materials contained on the Service at any time without notice.

2.6 User Accounts & Responsibility

You are responsible for:

  • Maintaining the confidentiality of your username and password
  • All activity under your account
  • Notifying us of unauthorized access
  • Creating strong, unique passwords
  • Keeping account information current and accurate

If you share access to your company account with team members, you are responsible for their actions within the Service.

2.7 Acceptable Use Policy

You agree not to use the Service to:

  • Transmit, upload, store, or distribute illegal content, including child sexual abuse material (CSAM), or material depicting illegal activities
  • Transmit, distribute, or promote sexually explicit content, pornography, or adult material
  • Promote, advertise, or facilitate the sale, purchase, or distribution of illegal drugs, controlled substances, or other illegal goods/services
  • Transmit unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable material
  • Violate any applicable local, state, national, or international law or regulation
  • Infringe upon intellectual property rights of others (copyright, trademark, patent, trade secrets)
  • Harass, abuse, threaten, bully, stalk, or intimidate any person or group
  • Promote violence, terrorism, hate speech, or discrimination against individuals or groups based on protected characteristics
  • Conduct fraudulent activities, scams, phishing, or financial schemes
  • Conduct automated access, web scraping, or data mining (exceeding fair use)
  • Attempt to gain unauthorized access to the Service or other users' accounts/data
  • Interfere with, disrupt, or overload the Service or servers/networks connected to it
  • Transmit viruses, malware, ransomware, or other harmful code
  • Impersonate another person, organization, or entity
  • Use the Service for spam, mass unsolicited communications, or commercial solicitation
  • Access or use the Service in any way that violates these Terms or applicable law

Enforcement: We reserve the right to investigate suspected violations, remove prohibited content, suspend access, or terminate accounts that violate this policy. We may report illegal activities to law enforcement and cooperate with legal investigations. Users who upload illegal content, particularly CSAM, will be reported to the National Center for Missing & Exploited Children (NCMEC) and appropriate authorities.

2.8 User-Generated Content

You retain ownership of all content you create (tasks, projects, notes, custom fields). By using the Service, you grant us a limited license to:

  • Store and transmit your content
  • Use your content as necessary to provide the Service
  • Analyze usage patterns for service improvement (anonymized)

We will not use your content for marketing or share it with third parties without permission, except as required by law.

2.9 Intellectual Property Rights

All content, features, and functionality of the Service (including but not limited to software, design, text, graphics, logos) are the exclusive property of ProdTracker.co, a service of Blue Tomato Media, or its content suppliers. They are protected by Australian and international copyright, trademark, and other intellectual property laws.

2.10 Subscription Terms & Billing

Subscriptions are billed according to the plan selected:

  • Billing occurs at the start of your subscription and each renewal period
  • We notify you 30 days before renewal to give you time to manage your subscription
  • You may cancel your subscription anytime. Cancellation takes effect at the end of the current billing period
  • Downgrading takes effect immediately; existing data remains but creation limits apply going forward
  • We reserve the right to change pricing with 14 days' notice or without notice
  • All charges are exclusive of applicable taxes, which you are responsible for paying

2.11 Refund Policy

ProdTracker.co subscriptions are recurring services. Refunds are available in the following cases:

  • Billing Error: If you were incorrectly charged due to a system error
  • Service Unavailability: If the Service was unavailable for more than 72 consecutive hours due to our fault
  • 30-Day Money Back: For new subscriptions (non-trial), you may request a full refund within 30 days of your first charge if you have not used the Service significantly

Trial periods have no refund eligibility. Refund requests must be submitted within 30 days of the charge. Once a refund is processed, trial or promotional access is immediately revoked.

2.12 Trial Periods

Free trial periods (if offered) are provided to evaluate the Service. You will not be charged during the trial period. When the trial ends, your account will automatically revert to the free Introductory plan. No credit card is required during the trial, and you will not be charged unless you actively choose to subscribe to a paid plan.

2.13 Plan Limits & Enforcement

Each subscription plan includes specified limits (users, projects, tasks, custom fields, API calls). When you reach these limits:

  • You cannot create new items exceeding the plan limit
  • Existing items remain accessible
  • To exceed limits, upgrade to a higher tier plan
  • Upgrading takes effect immediately; billing is prorated
  • If a payment fails, limits may be temporarily enforced with a grace period

2.14 Service Modifications & Termination

We reserve the right to:

  • Modify features or functionality with reasonable notice (typically 30 days)
  • Discontinue the Service or features with 60 days' written notice
  • Suspend your account immediately if you violate the Acceptable Use Policy or these Terms
  • Terminate accounts inactive for 12+ months

Upon termination, we will attempt to provide your data in an exportable format before deletion.

2.15 API Usage Terms

If your plan includes API access, you agree to:

  • Not exceed rate limits specified for your plan
  • Not use the API to circumvent plan limits (e.g., automating large data imports)
  • Not use the API for competitive purposes
  • Maintain API keys securely and not share them
  • Not attempt to reverse-engineer or scrape the Service

Violations may result in API access revocation or account suspension.

2.16 Third-Party Integrations

The Service may integrate with third-party services (Stripe, email providers, etc.). Your use of these services is subject to their terms and privacy policies. We are not responsible for their practices or service failures.

2.17 Indemnification

You agree to indemnify and hold harmless ProdTracker.co, its founders, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service in violation of these Terms
  • Your infringement of third-party intellectual property rights
  • Your violation of applicable law
  • Disputes with other users of the Service

2.18 Dispute Resolution

These Terms and your use of the Service are governed by the laws of your jurisdiction. Any disputes will be resolved through binding arbitration or small claims court, unless local law prohibits arbitration. You agree to attempt good-faith resolution before initiating formal proceedings.

2.19 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, earthquakes, floods, storms, fires, epidemics, pandemics, war, terrorism, civil unrest, government actions or sanctions, power outages, internet or telecommunications failures, cyberattacks, hardware or infrastructure failures, third-party service provider outages (including hosting, payment processing, and DNS providers), labour disputes, or any other event that could not have been reasonably foreseen or prevented. During such events, our obligations under these Terms are suspended for the duration of the event. If a force majeure event continues for more than 90 consecutive days, either party may terminate the agreement by written notice. In such cases, any prepaid fees for the unused portion of the subscription will be refunded on a pro-rata basis.

2.20 Export Compliance & Restricted Jurisdictions

The Service is controlled by laws of the jurisdiction where we operate. You agree not to export or re-export the Service or your content to prohibited countries or entities.

If you are located in a country, territory, or jurisdiction where local laws, regulations, sanctions, or government restrictions would prevent you from lawfully accessing or using the Service, you are forbidden from using ProdTracker.co. It is your responsibility to determine whether your use of the Service is lawful in your jurisdiction. By using the Service, you represent and warrant that you are not prohibited from doing so under any applicable law.

2.21 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and ProdTracker.co regarding your use of the Service. Any prior agreements, understandings, or negotiations are superseded. If any provision is found unenforceable, all other provisions remain in effect.

2.22 Modifications to Terms

We may update these Terms at any time without prior notice or consent. Changes become effective immediately upon posting to the website. Your continued use of the Service after any modifications constitutes acceptance of the updated Terms. We are under no obligation to notify you of changes, obtain your consent, or provide advance notice. It is your responsibility to review these Terms periodically for updates. If you do not agree with any modifications, your sole remedy is to discontinue use of the Service.

2.23 Severability

If any part of these Terms is determined to be invalid or unenforceable, that provision will be severed and all other provisions will remain in full force and effect.
